حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ عَنْ أَجْلَحَ عَنِ الشَّعْبِيِّ عَنْ عَبْدِ اللَّهِ بْنِ أَبِي الْخَلِيلِ عَنْ زَيْدِ بْنِ أَرْقَمَ أَنَّ نَفَرًا وَطِئُوا امْرَأَةً فِي طُهْرٍ فَقَالَ عَلِيٌّ رَضِيَ اللَّهُ تَعَالَى عَنْهُ لِاثْنَيْنِ مِنْهُمْ أَتَطِيبَانِ نَفْسًا لِذَا فَقَالَا لَا فَأَقْبَلَ عَلَى الْآخَرَيْنِ فَقَالَ أَتَطِيبَانِ نَفْسًا لِذَا فَقَالَا لَا قَالَ أَنْتُمْ شُرَكَاءُ مُتَشَاكِسُونَ قَالَ إِنِّي مُقْرِعٌ بَيْنَكُمْ فَأَيُّكُمْ قُرِعَ أَغْرَمْتُهُ ثُلُثَيْ الدِّيَةِ وَأَلْزَمْتُهُ الْوَلَدَ قَالَ فَذُكِرَ ذَلِكَ لِلنَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَا أَعْلَمُ إِلَّا مَا قَالَ عَلِيٌّ رَضِيَ اللَّهُ تَعَالَى عَنْهُ.
الترجمة الإنجليزية
Sufyan ibn Uyaynah told us, from Ajlah, from al-Sha'bi, from Abdullah ibn Abi al-Khalil, from Zayd ibn Arqam: that some men had intercourse with a woman during a single period of purity, and Ali, may Allah be pleased with him, said to two of them: Do you both willingly agree that the child belongs to this one? They said no. So he turned to the other two and said: Do you both willingly agree that the child belongs to this one? They said no. He said: You are quarrelsome partners; I shall cast lots among you, and whichever of you the lot falls upon, I will fine him two-thirds of the blood-money and assign him the child. He said: That was mentioned to the Prophet, peace and blessings be upon him, and he said: I know of nothing except what Ali, may Allah be pleased with him, has said.
