حَدَّثَنَا مُحَمَّدُ بْنُ مُصْعَبٍ حَدَّثَنَا الْأَوْزَاعِيُّ عَن الزُّهْرِيِّ عَن حَرَامِ بْنِ مُحَيِّصَةَ عَن الْبَرَاءِ بْنِ عَازِبٍ أَنَّهُ كَانَتْ لَهُ نَاقَةٌ ضَارِيَةٌ فَدَخَلَتْ حَائِطًا فَأَفْسَدَتْ فِيهِ فَقَضَى رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّ حِفْظَ الْحَوَائِطِ بِالنَّهَارِ عَلَى أَهْلِهَا وَأَنَّ حِفْظَ الْمَاشِيَةِ بِاللَّيْلِ عَلَى أَهْلِهَا وَأَنَّ مَا أَصَابَتْ الْمَاشِيَةُ بِاللَّيْلِ فَهُوَ عَلَى أَهْلِهَا.
الترجمة الإنجليزية
Muhammad b. Mus'ab told us, al-Awza'i told us, from al-Zuhri, from Haram b. Muhayyisah, from al-Bara' b. 'Azib, that he had a wild she-camel which entered an orchard and caused damage in it, so the Messenger of Allah, peace and blessings be upon him, ruled that guarding orchards by day is the responsibility of their owners, that guarding livestock by night is the responsibility of their owners, and that whatever damage livestock causes at night is the responsibility of their owners.
