حَدَّثَنَا حَفْصُ بْنُ عُمَرَ، عَنْ شُعْبَةَ، عَنْ أَبِي عَوْنٍ، عَنِ الْحَارِثِ بْنِ عَمْرِو بْنِ أَخِي الْمُغِيرَةِ بْنِ شُعْبَةَ، عَنْ أُنَاسٍ، مِنْ أَهْلِ حِمْصَ مِنْ أَصْحَابِ مُعَاذِ بْنِ جَبَلٍ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم لَمَّا أَرَادَ أَنْ يَبْعَثَ مُعَاذًا إِلَى الْيَمَنِ قَالَ " كَيْفَ تَقْضِي إِذَا عَرَضَ لَكَ قَضَاءٌ " . قَالَ أَقْضِي بِكِتَابِ اللَّهِ . قَالَ " فَإِنْ لَمْ تَجِدْ فِي كِتَابِ اللَّهِ " . قَالَ فَبِسُنَّةِ رَسُولِ اللَّهِ صلى الله عليه وسلم . قَالَ " فَإِنْ لَمْ تَجِدْ فِي سُنَّةِ رَسُولِ اللَّهِ صلى الله عليه وسلم وَلاَ فِي كِتَابِ اللَّهِ " . قَالَ أَجْتَهِدُ رَأْيِي وَلاَ آلُو . فَضَرَبَ رَسُولُ اللَّهِ صلى الله عليه وسلم صَدْرَهُ وَقَالَ " الْحَمْدُ لِلَّهِ الَّذِي وَفَّقَ رَسُولَ رَسُولِ اللَّهِ لِمَا يُرْضِي رَسُولَ اللَّهِ " .
الترجمة الإنجليزية
It is narrated from the companions of Hadrat Mu'adh ibn Jabal (may Allah be well pleased with him) from among the people of Hims that when the Beloved Messenger of Allah (blessings and peace of Allah be upon him) intended to send Hadrat Mu'adh to Yemen, he asked: How will you judge when a case comes before you? He submitted: I will judge by the Book of Allah. He asked: And if you do not find it in the Book of Allah? He submitted: Then by the Sunnah of the Beloved Messenger of Allah (blessings and peace of Allah be upon him). He asked: And if you do not find it in the Sunnah of the Beloved Messenger of Allah (blessings and peace of Allah be upon him) either? He submitted: Then I will strive with my own opinion and leave no stone unturned. He (blessings and peace of Allah be upon him) struck his chest and stated: Praise be to Allah who has guided the envoy of the Beloved Messenger of Allah (blessings and peace of Allah be upon him) to what pleases the Beloved Messenger of Allah (blessings and peace of Allah be upon him).
الترجمة الأردية
حضرت معاذ بن جبل رضی اللہ تعالیٰ عنہ کے اصحاب (اہلِ حمص) سے مروی ہے کہ محبوبِ کریم صلی اللہ تعالیٰ علیہ وآلہ وسلم نے جب حضرت معاذ کو یمن بھیجنا چاہا تو دریافت فرمایا: جب تمہارے سامنے کوئی مقدمہ آئے تو کیسے فیصلہ کرو گے؟ عرض کیا: میں اللہ کی کتاب سے فیصلہ کروں گا۔ ارشاد فرمایا: اگر اللہ کی کتاب میں نہ ملے؟ عرض کیا: تو رسول اللہ صلی اللہ تعالیٰ علیہ وآلہ وسلم کی سنت سے۔ ارشاد فرمایا: اگر رسول اللہ کی سنت میں بھی نہ ملے؟ عرض کیا: تو میں اپنی رائے سے اجتہاد کروں گا اور کوئی کمی نہیں چھوڑوں گا۔ آپ صلی اللہ تعالیٰ علیہ وآلہ وسلم نے اُن کے سینے پر ہاتھ مارا اور ارشاد فرمایا: اللہ کا شکر ہے جس نے رسول اللہ کے قاصد کو ایسی بات کی توفیق دی جو رسول اللہ کو پسند ہے۔
